1. Purchase Terms

PainMiner research reports are digital products delivered immediately upon payment. By purchasing, you agree to the following terms:

• Price: EUR 20 per report (recurring monthly for subscription access)
• Delivery: Digital delivery via password-protected link, delivered immediately upon payment
• Non-refundable: This is a digital product. Once delivered and accessed, no refunds are available
• Access Duration: Your access to the password-protected report remains valid for 30 days from the date of purchase
• Right of Withdrawal: Under consumer protection law in your jurisdiction, you have the right to cancel and receive a full refund within 14 days of purchase. However, once you access the password-protected report, your right of withdrawal is forfeited per consumer protection legislation on digital goods

2. Intellectual Property

• Copyright Ownership: All content in PainMiner reports, including analysis, pain point descriptions, quotes, source citations, and formatting, is the exclusive property of the operator (דמיטרי צ׳ולקין, operating under the trade name PainMiner)
• License Grant: You are granted a limited, personal license to access and read the report for your own internal business purposes only
• Restrictions: You may not:
  • Redistribute, resell, or share the report with any third party
  • Publish excerpts or full content publicly or privately without written permission
  • Use the report content in competing products or services
  • Remove, alter, or obscure any copyright or attribution notices
  • Sublicense, transfer, or assign your access rights to anyone else

3. Limitation of Liability

PainMiner provides research reports on an "as-is" basis using AI-assisted analysis of publicly available sources. To the maximum extent permitted by applicable law:

• No Warranty: We make no warranty that all information in the report is accurate, complete, or free from error
• Independent Verification Required: All findings, pain points, source citations, and financial figures should be independently verified by the reader before being relied upon for business decisions
• No Liability: PainMiner shall not be liable for any damages, losses, or consequences arising from your use of, or reliance on, information in this report, including lost profits, business interruption, reputational harm, or any indirect damages
• Correction of Errors: If you identify an error or inaccuracy in the report, please contact contact@aikraft.com. We will correct confirmed errors free of charge

4. Accuracy and AI Disclosure

• PainMiner research is conducted using AI-assisted analysis of publicly available forum discussions, review platforms, and community boards
• While we apply multi-stage verification processes, the use of AI means the report may contain errors or misinterpretations
• All claims are sourced from public discussions and should not be interpreted as verified facts or legal conclusions
• Individual pain points should be independently verified before being relied upon for product development, investment, or other business decisions

5. Governing Law and Dispute Resolution

• Governing Law: These terms are governed by the laws of the State of Israel. Nothing in these terms limits any mandatory consumer-protection rights you may have under the laws of your country of residence
• Jurisdiction: Any disputes arising from this agreement shall be resolved through good-faith negotiation or mediation

6. Cancellation and Refund Policy

• Cancellation Right: You may cancel your subscription or research access at any time by emailing contact@aikraft.com
• Refund Eligibility:
  • Refunds are available within 14 days of purchase if you have NOT yet accessed the password-protected report
  • Once you have accessed the report, no refund is available, even if within the 14-day window
• Subscription Cancellation: For recurring monthly subscriptions, your access will be disabled within 24 hours of cancellation request. No prorated refunds are issued for partial months
• Refund Method: All refunds will be processed to your original payment method within 7–10 business days

7. Account Password Security

• Each report is accessed via a unique password provided after purchase
• You are responsible for keeping your password confidential and secure
• You may not share your password with other users or allow unauthorized access
• PainMiner may revoke access if we detect sharing or unauthorized use

8. Service Availability

• PainMiner does not guarantee 100% uptime for the report access portal
• We may modify, suspend, or discontinue the service with reasonable notice
• In the event of service disruption, we will make reasonable efforts to restore access

9. Privacy and Data Protection

Your use of PainMiner is also governed by our Privacy Policy. For information about how we collect, use, and protect your personal data, please review the Privacy Policy.

10. Removal and Correction Policy

If your business name appears in a PainMiner report and you wish to be removed, or if you believe a statement is inaccurate, please email contact@aikraft.com with:

• Your business name and contact information
• The specific pain point or statement you wish to have removed or corrected
• Your reason for the request

We will review all removal and correction requests and respond within 7 business days. Requests that comply with consumer protection laws will be honored at no cost.

12. Changes to These Terms

PainMiner reserves the right to modify these terms. Material changes will be posted on this page at least 30 days before taking effect. Your continued use of the service after the 30-day notice period constitutes acceptance of the modified terms. Changes that are required by law or that benefit the user may take effect immediately.

13. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
